FIVE THINGS U.S. ATTORNEYS SHOULD KNOW ABOUT CANADIAN TRADEMARKS

  1. Costs & Classes: Government fee of $250 for application plus $200 for registration, for a total of $450, regardless of the number of classes involved. Canada does not yet charge on a per class basis.
  2. U.S. Trademark Certificate: Can be used as a basis for registration, without use in Canada.
  3. U.S. Trademark Application: Can be used to establish a priority date in Canada, up to six months after the U.S. filing.
  4. Supplemental Register: There is no Supplemental Register in Canada.
